Welcome to the Dear Luna Beauty website (the “Website”). Dear Luna Beauty operates as a premier studio specializing in luxury eyelash extensions, bridal hair and makeup, and photoshoot hair and makeup services in Calgary, Alberta, and surrounding areas. By accessing or using this Website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Website. Dear Luna Beauty (including its owners, employees, agents, and affiliates, collectively “the Salon”) reserves the right to update these Terms at any time, with changes effective upon posting on the Website. Your continued use of the Website after changes constitutes acceptance of the updated Terms.

1. Use of the Website

  • Eligibility: You must be at least 18 years old to use the Website or book services independently. Users under 18 require parental or guardian consent, or must be deemed a mature minor under Alberta law (typically 14-16 years old, subject to assessment by the Salon). By using the Website, you represent that you meet these eligibility requirements.

  • Permitted Use: The Website is for personal, non-commercial use to learn about, book, or inquire about the Salon’s services. You agree not to misuse the Website (e.g., hacking, distributing malware, posting unlawful content, or scraping data). Violation may result in termination of access.

  • Account Responsibility: Bookings are facilitated through Acuity Scheduling (“Acuity”), a third-party platform integrated with the Website. If you create an Acuity account or provide information for bookings, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to comply with Acuity’s terms of service (available at https://acuityscheduling.com/terms-of-service.php).

2. Booking and Payment Terms

  • Online Bookings: Appointments are booked via Acuity on the Website and are subject to availability and confirmation by the Salon. You agree to provide accurate contact, health, and payment information during booking. All bookings are subject to the Salon’s Client Consent and Release of Liability Form, which must be completed and signed (electronically or in-person) prior to services.

  • Cancellation and No-Show Policy: Cancellations or rescheduling require 24-hour advance notice via Acuity or by contacting the Salon. Late cancellations or no-shows may incur a fee equal to 50% of the service cost, charged via the payment method on file. Repeated violations may result in refusal of future bookings or service. This policy complies with Alberta’s Fair Trading Act and helps ensure availability for all clients.

  • No Refunds: Payments for services, including deposits or pre-payments processed through Acuity (via third-party processors like Stripe or PayPal), are non-refundable, except as required by law under Alberta’s Fair Trading Act. Dissatisfaction with results, allergic reactions (known or unknown), or changes in personal circumstances do not entitle you to a refund. All sales and services are final.

  • Pricing: Prices displayed on the Website and in Acuity are in Canadian dollars (CAD), exclusive of applicable taxes (e.g., GST/HST), and subject to change without notice. Taxes are calculated and added at booking in accordance with Canadian tax laws.

3. Service Disclaimers

  • No Guarantee of Results: The Salon does not guarantee specific outcomes for eyelash extensions, lash lifts/tints, bridal hair/makeup, or other services, as results vary based on individual factors (e.g., natural lash/skin condition, aftercare compliance). Services are provided in compliance with Alberta’s Personal Services Regulation and Standards for public health and safety.

  • Health and Safety: Clients must disclose medical conditions, allergies, or contraindications during booking or via the Client Consent Form. Services may be refused if risks are identified. Patch tests for sensitivities are recommended 24-48 hours prior; declining is at your own risk.

  • Third-Party Integration: Bookings and payments are handled by Acuity, governed by Acuity’s terms and privacy policy. The Salon is not liable for any issues arising from Acuity’s platform, including technical failures or data handling. By booking, you agree to Acuity’s terms.

  • Right to Refuse Service: The Salon reserves the right to refuse or cancel any booking or service at its sole discretion, including for reasons such as tardiness, non-compliance with preparation requirements (e.g., clean lashes), misconduct, harassment, or health/safety concerns, in accordance with Alberta regulations. A zero-tolerance policy applies to disruptive behavior.

4. Intellectual Property

  • All content on the Website (e.g., text, images, logos, service descriptions) is owned by or licensed to the Salon and protected by Canadian copyright and trademark laws. You may not reproduce, distribute, or modify content without written permission.

  • By submitting content (e.g., reviews, photos via Acuity intake forms), you grant the Salon a perpetual, royalty-free, worldwide license to use, edit, and publish it for promotional purposes, subject to your privacy rights under Alberta’s Personal Information Protection Act (PIPA).

5. Limitation of Liability

  • To the fullest extent permitted by Alberta law, the Salon, Squarespace (the Website host), and Acuity are not liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from your use of the Website, bookings, or services, including but not limited to booking errors, service dissatisfaction, data breaches, allergic reactions, or technical issues with third-party platforms, whether caused by negligence or otherwise.

  • The Website and services are provided “as is,” with no warranties, express or implied, regarding functionality, accuracy, availability, or results. The Salon’s total liability shall not exceed the amount paid for the service in question.

6. Indemnification

  • You agree to indemnify, defend, and hold harmless the Salon, Squarespace, Acuity, and their affiliates from any claims, losses, or damages arising from your use of the Website, violation of these Terms, inaccurate information provided during booking, or infringement of third-party rights.

7. Termination

  • The Salon may suspend or terminate your access to the Website or bookings at its discretion, including for violation of these Terms, non-payment, or disruptive behavior.

8. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Calgary, Alberta.

  • You agree to attempt informal resolution with the Salon (via email or phone) before pursuing legal action.

10. Severability
